Radiation -occupational hazard --legal opinion
long back ,one learned senior lawyer asked me to give my opinion on a legal notice issued by a radiologist to the health department in a south african nation.
the radiologist was asking for a compensation from the department of health because he had a fracture of his femur at the age of 60 years and he attributed this to the radiation work ( bone marrow depression ) he was doing in that hospital where he was employed for 4 years
the lawyer asked me how he can reply to the notice on behalf of the department .
i told the lawyer that the radiation dose received by any individual has a cumulative effect and it is a well known professional knowledge and if somebody wants to sue the employer for that, he has to send notice to all the places where he was employed and it is a well accepted professional or job risk.. in other simple words the radiologist must sue all the hospitals in which he worked and ask for compensation from all and not from the present hospital alone
the lawyer ,a nice gentleman ,phoned me later to say that his reply notice on behalf of the health department ,really worked well !!!
